The Contentious Gap: While the FIR was registered on the 18th, the posts in question were made on December 14, 2025, indicating a four-day delay utilized to construct a narrative of "coordinated" harm.

The "Coordinated Manner" Theory: The police rely on Para 15 and 16 of the DCP’s Affidavit to bridge two unrelated accounts. They attempt to link Dr. Patil’s single-line post—which asked why "andhabhakta" and "40 paisa wale" were silent on a sex scandal—with a post from an ID named "Shahar Vikas Aghadi."

The Vulgarity Bridge: The "Shahar Vikas Aghadi" post allegedly linked the Prime Minister to a woman with "obscene remarks." By alleging a "coordinated conspiracy" based on similar timestamps, the police are attempting to pin the "vulgarity" of an unrelated account onto Dr. Patil to justify the gravity of a BNS 353(2) charge.


This theory of "common authorship" serves as the foundational justification for the Look Out Circular (LOC), despite Dr. Patil having no admin rights or connection to the "Shahar Vikas Aghadi" page.

The "Unanswered" Core: Deconstructing the Failure to Meet Statutory Ingredients

Dr. Patil’s Rejoinder (Para 9) argues that the police response is "replete with bald assertions" that fail to satisfy the co-existence of the three mandatory ingredients of Section 353(2). Crucially, the police have failed to identify the specific groups allegedly set against each other, as the law requires enmity between groups based on religion, race, language, region, caste, or community.

Jurisdictional Innovation: Claims the posts create hostility between "followers and non-followers" of a political ideology/leader.


False Information/Rumors: Requires dissemination of false information or alarming news. Subjective Labels: Characterizes the post as "vulgar" and "lascivious" without proving factual falsehood in the rhetorical question.


Intent to Promote Hatred: Requires specific intent to promote hatred between the six defined groups. Speculative Harm: Cites the potential to "disturb public order" without citing a single incident of actual violence or communal tension.


The Petitioner’s critique of this "innovation" is vital: if the court accepts "political followers" as a protected group under BNS, it effectively criminalizes all harsh political opposition. Relying on the Supreme Court precedent in Bilal Ahmed Kaloo v. State of A.P., Dr. Patil argues that the absence of two specific, legally recognized communities is a fatal defect that cannot be cured by the police’s subjective "hurt feelings."

Digital Sovereignty and the "Non-Cooperation" Dispute



The Mumbai Police have centered their defense on Dr. Patil’s alleged "evasive conduct" regarding digital evidence. However, this appears to be a "fishing and roving inquiry" designed to bypass constitutional safeguards.

1. Police Claim: The affidavit alleges Dr. Patil "deliberately avoided" submitting his phone and laptop, raising "reasonable suspicion of deliberate concealment" (DCP Affidavit Para 20).


2. The 14-Hour Interrogation: Dr. Patil notes in his Rejoinder (Para 13) that he was interrogated for 14 hours on January 10 and submitted a 17-page written response.


3. The OTP Mechanism: The police demand an "on-site demonstration" of his Facebook account. Dr. Patil’s rebuttal clarifies that his 2-factor authentication (OTP) is linked to a laptop physically located in the United Kingdom, making an on-site demo a technical impossibility that the police have conveniently labeled as "non-cooperation."


The state’s focus on his "Tourist Visa" (Para 17, 22) is a notable red herring. Dr. Patil argues this is a distraction "beyond the scope of the FIR," as his social media activity predates his entry into India and is irrelevant to the statutory ingredients of a BNS offense.



The Look Out Circular (LOC): Prevention or Punishment?



The use of the Look Out Circular (LOC) in this case represents the most severe exercise of state power, effectively stranding a UK-based professional in India. The Petitioner frames this not as a preventive measure, but as "procedure as punishment."


The "Flight Risk" Paradox The chronology suggests a betrayal of procedural assurance:


Jan 10: Dr. Patil voluntarily enters India and cooperates with a marathon interrogation. The police allow him to leave, signaling he is not a flight risk.

Jan 16: In a meeting with the DCP (Crime), Dr. Patil is reportedly assured that the police are "reversing" the LOC.

Jan 19: When Dr. Patil arrives at the airport, he is blocked. His passport is endorsed with "Emigration Prohibited," despite the prior verbal assurances of the state.


"The LOC serves as 'procedure as punishment,' causing financial loss and professional damage... it is a grossly disproportionate measure that converts investigation into punishment," Dr. Patil asserts in his Written Submissions.


By maintaining the LOC for a case based on a single-line, publicly available post, the state utilizes a tool intended for "exceptional circumstances" (like absconding terrorists) against a medical professional who has voluntarily presented himself for interrogation.


Judicial Benchmarks: Free Speech and the Bhajan Lal Test


The High Court must now evaluate this case against the State of Haryana v. Bhajan Lal test. Dr. Patil argues that the prosecution falls squarely within the categories for quashing under Article 226 and Section 528 of the BNSS (the new procedural equivalent of Section 482 CrPC).


The Chilling Effect of Innovation: The Petitioner relies heavily on Kerala High Court precedents, Gowri Sankari v. State of Kerala and Manu S. v. State of Kerala, which establish that "mere criticism of the Government, even if unpalatable, cannot trigger criminal prosecution." These rulings underscore that unless speech reaches the level of incitement to public disorder, the state has no jurisdiction to criminalize dissent.


The Mumbai Police’s failure to identify "identifiable groups" as required by BNS is not a mere oversight; it is a foundational defect. If the prosecution is allowed to proceed based on the "innovation" of political followers as a protected class, it creates a chilling effect on all democratic discourse. By focusing on "non-cooperation" and visa technicalities, the police affidavit seeks to distract the court from the reality that the FIR is "manifestly attended with mala fides" and "instituted to wreak political vengeance." In the extraordinary jurisdiction of the High Court, the state’s inability to meet the basic statutory ingredients of the BNS may prove fatal to their case.

नंदुरबार जिल्ह्यातील सातपुडा पर्वतरांगेतील सादरी पाड्यावर स्वातंत्र्याच्या ७८ वर्षांनंतर पहिल्यांदाच नळाद्वारे पाणी पोहोचलं. नर्मदा नदीच्या काठावर वसलेलं गाव असूनही ग्रामस्थांना पिण्याच्या पाण्यासाठी दररोज डोंगर-दऱ्या उतरून नदीपर्यंत जावं लागत होतं. जलजीवन मिशनसारख्या योजनांचे दावे असतानाही या दुर्गम आदिवासी पाड्यावर पाण्याची समस्या कायम होती. ग्रामस्थांच्या श्रमदानातून, यंग फाउंडेशनच्या पुढाकारातून आणि DJED फाउंडेशनच्या आर्थिक मदतीतून दोन महिन्यांत ही पाणी योजना उभी राहिली. सादरी पाड्यावर आलेलं हे पाणी केवळ एका गावाची तहान भागवणारं नाही, तर सातपुड्यातील शेकडो दुर्गम आदिवासी पाड्यांच्या वास्तवावर प्रकाश टाकणारं उदाहरण आहे.
